How Nicotine and Tobacco Products Are Legally Shipped

Nicotine pouches and chewing tobacco are both classified as smokeless tobacco products under the federal PACT Act (Prevent All Cigarette Trafficking Act) — the same law that governs how any tobacco product can be mailed or shipped across state lines in the United States.

One detail that surprises a lot of first-time customers: the U.S. Postal Service does not carry smokeless tobacco at all. USPS classifies smokeless tobacco as non-mailable matter, full stop, regardless of registration or licensing. That means orders from MissTobacco move through PACT Act–registered private carriers, not USPS — which is standard across this entire product category, not something unique to us.

Our Compliance Obligations

As a PACT Act–registered retailer, we’re required to:

  • Register with the U.S. Alcohol and Tobacco Tax and Trade Bureau (TTB) and the ATF before shipping any order
  • File a delivery sales report with each state we ship to, due by the 10th of the month following the sale — separately, per state
  • Verify the age of every purchaser at checkout, and require an adult signature (21+) at the point of delivery
  • Label every shipping package with the required tobacco product statement, as mandated by the PACT Act
  • Use only carriers that are themselves PACT Act–compliant for tobacco shipments

Where We Ship

Coverage is determined by two layers stacked on top of each other: federal PACT Act eligibility, and each individual state or province’s own tobacco and nicotine product laws, which vary independently and change periodically as new state legislation takes effect.

We do not ship to any state or Canadian province where the applicable product category is currently restricted or prohibited. If your delivery address falls in a restricted region, this will be flagged before you complete checkout.

Canada Coverage

Minimum age requirements vary by province — 18 in most provinces, 19 in others (including Quebec, at 18). As with U.S. state law, provincial nicotine and tobacco regulations shift periodically, so eligibility is confirmed at checkout against current rules rather than a static list on this page.

Discreet Packaging

Every order ships in plain, unmarked packaging with no external branding indicating the contents — standard practice across the industry for age-restricted products, and required in some jurisdictions.

Age Verification at Delivery

Per PACT Act requirements, an adult aged 21 or older (or the applicable Canadian provincial minimum) must sign for the package at the time of delivery. If no eligible adult is available, the carrier will hold the package for pickup or return it to us — it will not be left unattended.
